The Application collects your device’s location, including background location, which helps the Service Provider make use of it in the following ways:

Core Features (Background Location): The Application collects location data to enable “Live Location Sharing” and “Route Tracking” features even when the app is closed or not in use. This allows you to seamlessly share your real-time position, altitude, and speed with your selected groups during outdoor activities or coordinate movements without keeping the screen active.
User-to-User Sharing: Your location and custom map data (markers, lines, areas) are actively shared with other users who are members of the same groups you join. This information is only visible to the members of those specific groups.
Analytics and Improvements: Aggregated and anonymized location data helps the Service Provider analyze user behavior, identify trends, and improve the overall performance and functionality of the Application.

You can stop the background location tracking at any time by stopping the live tracking feature within the app, or by revoking the background location permission in your device’s settings.

The Application does not use Artificial Intelligence (AI) technologies to process your data or provide features.

The Service Provider may use the information you provided to contact you from time to time to provide you with important information, required notices, and marketing promotions.

For a better experience, while using the Application, the Service Provider may require you to provide us with certain personally identifiable information (such as your Name, Email Address, etc.). The information that the Service Provider requests will be retained by them and used as described in this privacy policy.

Third Party Access

Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.

Data Deletion: You have the right to request the deletion of your personal data. You can delete your account and associated data directly within the Application settings. **4.2 LIMITED LICENSE.** WE GRANT YOU A PERSONAL, NON-EXCLUSIVE, NON-TRANSFERABLE, REVOCABLE LICENSE TO USE THE SERVICES FOR YOUR PERSONAL, NON-COMMERCIAL USE ONLY.

**4.3 USER CONTENT.** YOU RETAIN OWNERSHIP OF THE DATA AND PHOTOS YOU UPLOAD (“USER CONTENT”). HOWEVER, BY UPLOADING USER CONTENT, YOU GRANT US A WORLDWIDE, ROYALTY-FREE, NON-EXCLUSIVE LICENSE TO HOST, STORE, AND PROCESS SUCH CONTENT SOLELY FOR THE PURPOSE OF PROVIDING THE SERVICES TO YOU.

### 5. PROHIBITED ACTIVITIES

YOU AGREE NOT TO:

* Use the Services for any illegal or unauthorized purpose.

* Attempt to decompile, reverse engineer, or extract source code from the Services.

* Interfere with or disrupt the integrity or performance of the Services.

* Use the AI features to generate harmful, medical-diagnostic, or prohibited content.

* Automate access to the Services (scrapers, bots, etc.) without our written consent.

### 6. SUBSCRIPTIONS, PAYMENTS, AND CANCELLATIONS

**6.1 SUBSCRIPTION MODELS.** WE OFFER FREE AND PAID “PREMIUM” SUBSCRIPTIONS. PREMIUM FEATURES ARE SUBJECT TO THE PAYMENT OF RECURRING FEES.

**6.2 AUTO-RENEWAL.** PAID SUBSCRIPTIONS AUTOMATICALLY RENEW UNLESS CANCELLED AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT BILLING CYCLE.

**6.3 THIRD-PARTY PROCESSING.** PAYMENTS ARE PROCESSED THROUGH THE APPLE APP STORE OR GOOGLE PLAY STORE. YOUR PURCHASE IS SUBJECT TO THEIR RESPECTIVE TERMS AND PRIVACY POLICIES.

**6.4 REFUNDS.** ALL FEES ARE NON-REFUNDABLE EXCEPT AS REQUIRED BY LAW OR BY THE POLICIES OF THE APP STORE PROVIDER.

### 7. THIRD-PARTY SERVICES AND LINKS

OUR SERVICES MAY INTEGRATE WITH OR PROVIDE LINKS TO THIRD-PARTY WEBSITES OR SERVICES (E.G., FIREBASE, REVENUECAT). WE DO NOT ENDORSE OR ASSUME ANY RESPONSIBILITY FOR ANY SUCH THIRD-PARTY SITES, INFORMATION, MATERIALS, OR SERVICES.

### 8. INDEMNIFICATION

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS BABY JOURNAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, OR DEBT, AND EXPENSES (INCLUDING LEGAL FEES) ARISING FROM: (I) YOUR USE OF THE SERVICES; (II) YOUR VIOLATION OF THESE TERMS; OR (III) YOUR VIOLATION OF ANY THIRD-PARTY RIGHT, INCLUDING WITHOUT LIMITATION ANY INTELLECTUAL PROPERTY OR PRIVACY RIGHT.

### 9. LIMITATION OF LIABILITY

**9.3 CAP ON LIABILITY.** OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
